You are solely responsible for the Training Data you upload and the behavior and responses of the AI agents you create and deploy. You must ensure your use of the Services, including the data processed by your deployed AI agents, complies with all applicable laws, including data privacy regulations (e.g., GDPR, CCPA).

5. Intellectual Property

Our IP: The Services, including the platform, website design, software, underlying technology (excluding third-party AI models), and content provided by us (excluding user-provided Training Data), are the property of CreateMyChat.com and its licensors, protected by copyright and other intellectual property laws.

Your IP: You retain all ownership rights to the Training Data you upload to the Services. By uploading Training Data, you grant CreateMyChat.com a worldwide, non-exclusive, royalty-free license to use, reproduce, modify (solely for formatting/technical purposes), and process such data solely for the purpose of providing and improving the Services *for you* (e.g., training your specific AI agent). We will not use your confidential Training Data to train general AI models for other customers unless you explicitly opt-in to such a program.

6. Fees and Payment

Some Services may be provided for a fee. You agree to pay all applicable fees as described on our Pricing page or applicable order form. Fees are non-refundable except as required by law or as explicitly stated in our refund policy (if any). We reserve the right to change our prices and payment terms with reasonable notice.

7. Termination

We may suspend or terminate your access to the Services at any time, for any reason, including violation of these Terms. You may terminate your account at any time by following the instructions on the platform or contacting us. Upon termination, your right to use the Services will cease immediately, and we may delete your account and associated Training Data according to our data retention policies.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CreateMyChat.com DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. THE ACCURACY AND RELIABILITY OF RESPONSES GENERATED BY AI AGENTS DEPEND HEAVILY ON THE TRAINING DATA PROVIDED AND THE CAPABILITIES OF THE UNDERLYING AI MODELS, AND ARE NOT GUARANTEED.

9. Limitation of Liability

IN NO EVENT SHALL CreateMyChat.com, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (III) ANY CONTENT OBTAINED FROM THE SERVICES, INCLUDING RESPONSES FROM AI AGENTS; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

10. Governing Law
